The sooner you act the better. If you leave it too late you may lose the right to make your claim for compensation! If you have been involved in an accident in which you have sustained injury, it is better for the facts to be investigated while they are still fresh in your mind and other evidence is often easier and better in quality when it is obtained at an early stage.

Road Traffic Accidents
Even if you walk away from a road accident with minor injuries you may have suffered trauma. Some road accidents can leave you with injuries such as whiplash - an injury to the neck. You may be entitled to financial compensation if someone else was responsible for causing the accident. For example:

Driver - if you were the driver of a vehicle involved in an accident for which another driver was to blame.

Passenger - if you were a passenger in a vehicle involved in an accident and your driver or the driver of another vehicle caused the accident. It does not matter whether the driver of your car was a member of your family or a friend there should be compulsory insurance arrangements to cover claims in these situations.

Pedestrian - if you were a pedestrian that was struck by a motor vehicle then if the accident was wholly the fault or partly the fault of the driver of the vehicle, you would have an entitlement to claim compensation.

Cyclists - if you were knocked off your bicycle by a motorist, you may have an entitlement to compensation.

Motorcyclists - if a vehicle has not seen you and pulled into your path, you may have an entitlement to compensation.

Pillion passengers - if you were a pillion passenger on a motorcycle involved in an accident which was the fault of the motorcyclist or the driver of another vehicle, you may have a claim for compensation. Don't worry if the motorcyclist is a friend or family member because there should be compulsory insurance in place in these circumstances.

Other Accidents
Other types of accidents and injuries that may result in you being able to make a claim are:

  • Slips and Trips
  • Leisure or sporting activities
Whether your accident or injury is minor or major you are entitled to compensation if you can show that someone else was at fault. For example if your accident was at work this would be you employer. If your injury was sustained by a slip or trip, anyone who is responsible for the maintaining and running of a public place for example; offices, pavements, shops, public highways and leisure attractions has a duty to make that place safe.

As a rule of thumb, if you can prove that your accident or injury was someone else's fault, you probably have good grounds to make a claim for compensation.
